Sabah issue in international law

Under a treaty entered into with the sultans of Sulu and Maguindanao in 1640, the Spaniards recognized the independence of the two sultanates. Thus, the Sulu sultan later became the sovereign ruler of Sabah.


A 10-year civil war broke out in Brunei between two sultans, one of whom—Sultan Muaddin—requested military aid from the Sulu sultan. In 1675, the Brunei civil war ended. The victor, Sultan Muaddin, later ceded Sabah to the Sulu sultan.

In 1878, the Sulu sultan entered into a deed of pajak with Austrian Gustavus Baron de Overbeck and Englishman Alfred Dent, who were representatives of a British company. The deed was written in Arabic. In 1946, professor Harold Conklin translated the term pajak as “lease.” The 1878 Deed provided for an annual rental.

Main basis of dispute

This treaty constitutes the main basis of the territorial dispute between the Philippines and Malaysia over Sabah. The Philippines claims that the term pajak means lease while Malaysia claims that it means cession.

“Lease” means a contract by which a rightful possessor of real property conveys the right to use and occupy the property for consideration, usually rent. “Cession” means the relinquishment or transfer of land from one state to another.

In 1881, the syndicate represented by Overbeck and Dent was chartered as British North Borneo Co. (BNBC). In 1898, under the Treaty of Paris, Spain sold the Philippines to the United States. The treaty boundaries allegedly did not include Sabah.

During World War II, the Japanese occupied Brunei. After the war, in 1946, the British Crown granted Brunei the status of crown colony. In 1963, Sabah joined Malaysia.

What’s at stake

At stake in the territorial dispute over Sabah between the Philippines and Malaysia are two main prizes: natural resources and national security.

Sabah has been found to contain rich oil and gas reserves, according to the Singapore-based Facts Global Energy. It is said that significant pipeline projects, to be led by Malaysian companies in Sabah, will bring about the first gas production by May 2015 and power production by November 2015.

Sabah also poses a security risk for both countries because it is allegedly the lair of the al-Qaida-linked regional terror group Jemaah Islamiyah. Hence, Sabah could be used by terrorists as the springboard for a pan-Islamic state.

Philippine claim

The Philippine claim is based on the argument that the 1878 Deed or pajak was a treaty of lease.

In 1950, Congress adopted a “concurrent resolution expressing the sense of the Philippines that North Borneo belongs to the heirs of the sultan of Sulu and the ultimate sovereignty of the Republic of the Philippines, and authorizing the President to conduct negotiations for the restoration of such ownership and sovereign jurisdiction over said territory.”

In 1961, President Diosdado Macapagal filed the Philippine claim to Sabah. The next year, in the UN General Assembly, the Philippine Vice President appealed for help in promoting a peaceful resolution to the Sabah issue.

Heirs’ declaration

In 1962, the heirs of the Sulu sultan issued a declaration, titled “Recognition and authority in favor of the Republic of the Philippines,” which ceded and transferred sovereignty over Sabah to the Philippines. The Republic of the Philippines accepted the cession of sovereignty made by the Sulu sultan. In that same year, Congress reiterated its 1950 resolution.

The Sulu sultan’s heirs later met with President Corazon Aquino, who advised them to organize themselves. She wrote the Malaysian prime minister asking him to increase the lease payment. However, Malaysia contended that in 1989, the Sulu sultan’s heirs had revoked their authorization issued to the Philippine government as their representative. In 2001, another heir sent another demand letter for an increase in lease payments.

PH retains claim

In 2008, President Gloria Macapagal-Arroyo issued “Guidelines on Matters Pertaining to Sabah,” which required any official activity related to Sabah to first obtain clearance from the Department of Foreign Affairs. In 2009, Arroyo signed the new law on the archipelagic baselines of the Philippines, which I sponsored. This law was upheld in 2011 by the Supreme Court, which categorically stated that the Philippines retained its claim to Sabah.

It should be emphasized that the Philippine claim has been supported by no less than the British minister of foreign affairs at the time, Earl Granville. He was negotiating the 1885 protocol and at one point he was replying to the protest of Spain and the Netherlands over the grant of the royal charter to BNBC, which included North Borneo. Granville said that the BNBC charter also “recognizes the grants of territory and powers of government made and delegated by the Sultans in whom the sovereignty remains vested.”

In the further course of negotiations among certain colonial powers, Granville again stated: “The sovereignty in our view is vested in the Sultans and was merely delegated by them to the company by their concessions.”

Malaysian claim

The Malaysian claim is based on the argument that the original document was a treaty of cession. Malaysia traces its claim to the 1878 Deed signed by the Sulu sultans in favor of the adventurers Overbeck and Dent, members of a syndicate, which was eventually organized into BNBC. It is claimed that the two adventurers entered into the 1878 Deed as representatives of BNBC and thus attained sovereignty over Sabah.

In June 1946, the British Crown and BNBC entered into an agreement, which appears to cede and transfer all the rights, powers and interests of BNBC on North Borneo to the British Crown.

End with nothing

As in astrophysics, in international law, if you begin with nothing, you end with nothing. The two Europeans never acquired sovereignty over Sabah and had no power to transfer that sovereignty to BNBC, to the British Crown or to Malaysia, which is merely a successor-in-interest to Britain.

In February 1964, the Malaysian prime minister entered into an understanding with the Philippine President to discuss “as soon as possible the best way of settling the dispute, not precluding reference to the International Court of Justice.” In August of that year, the two governments, in an exchange of aides-memoire, authorized a meeting of their representatives in Bangkok to clarify the Philippine claim and discuss the means of settling the dispute.

In 1966, Malaysia sent a diplomatic note repeating its assurances on the concern of the two governments over the Sabah dispute. In February 1966, the Philippines proposed “that both governments agree as soon as possible on a mode of settlement that is mutually acceptable to both parties.”

As a student of international law, I humbly submit that the historical records indicate that sovereignty over Sabah was vested in the Sulu sultan. In turn, the sultan’s heirs ceded sovereignty over Sabah to the Philippines. Therefore, it is the Philippines that now possesses sovereignty over Sabah.

In contrast to the Philippine claim, Malaysia’s claim is based only on two British representatives, Overbeck and Dent, who entered into the so-called 1878 Deed. Since the Malaysian claim ultimately depends upon this deed, then the claim is questionable on two grounds.

First, since the deed is written in Arabic, it is a question whether the intent was to engage in a deed of lease or in a deed of cession. Second, under international law, British nationals could not assume state sovereignty; they had no legal status to accept a deed of cession of territory.

Principle of lease of territory

Under international law, a lease of territory is an agreement by which a subject, ordinarily a state, grants another subject of international law, also ordinarily a state, the right to use and exercise control over part of the former’s territory. Once territory is leased, sovereignty over it remains with the lessor and is divorced from jurisdiction, which is granted to the lessee. Lease of territory is usually granted in return for an annual fee.

Wrongful acts committed with respect to a leased territory follow the general rules of attribution. Since Malaysia apparently has committed wrongful acts, which have resulted in the deaths of Filipinos in Sabah, Malaysia has assumed state responsibility. Under international law today, the focus is on the human rights obligations of Malaysia toward the Filipino individuals and population associated with Sabah.

Principle of ‘effectivités’

In the dispute between the Philippines and Malaysia over Sabah, neither side appears to have considered the principle of effectivités. This is a French term referring to acts undertaken in the exercise of state authority, to which a state manifests its intention to act as a sovereign over a territory.

Not every person can display state sovereignty. Only persons whose acts are attributable to a state can perform an act undertaken in the exercise of sovereignty on its behalf. The acts of private entities are in principle not attributable to a state. Thus, they cannot create a title of sovereignty for a state. In the case of the Europeans Overbeck and Dent, the issue is whether those two persons were allowed to exercise elements of governmental authority.

Under international law, the presence of a population in a territory is not in itself determinative for deciding which state is the holder of the territorial title of sovereignty. But in brief, in a territorial dispute, the legal value of effectivités is to be assessed according to the existence or nonexistence of legal title.

Effectivités undertaken by the Malaysian government do not create a territorial title because Malaysia has no title of sovereignty over Sabah. Because the title of sovereignty over Sabah is held by the Philippines, our title has primacy over contradictory effectivités of Malaysia. The effectivités of Malaysia are unlawful and cannot in themselves create a title of sovereignty.

When we analyze a territorial dispute, we have to painstakingly consider state conduct. Philippine state conduct serves to maintain our right of sovereignty over Sabah. Even if the Philippines has lost control of its territory, the country continues to claim Sabah by issuing protests and by enacting legislation, or by taking relevant conduct regarding Sabah, by which it manifests its intent to remain the sovereign.

Diplomatic protection

Contemporary international law prohibits the use of force. However, some authors claim that as part of the lex lata, there is an unwritten exception, which allows states to protect or rescue their nationals by means of armed forces in the territory of another state. With respect to the Sabah event, I do not subscribe to this exception because no armed attack has been made on Philippine territory. Without an armed attack, there can be no lawful self-defense.

Rescue operation

However, I humbly take the position that it is now a rule of customary international law that a limited forcible action, with the legitimate aim of rescuing a state’s own nationals, provides unwritten justification to use armed force in Sabah without the consent of Malaysia. Since 1960, these rescue operations have been a feature of modern state practice. Authorities say, “The opinio juris of the states carrying out the rescue operations would seem to carry enough weight, as to give evidence of an unwritten rule in customary international law.”

Should the Philippines engage in a rescue operation for Filipinos in Sabah, the country should conform to the following preconditions:

1. The lives of Filipinos should be genuinely in danger;

2. Malaysia is unwilling or unable to ensure the safety of the persons concerned (ultima ratio);

3. The Philippines does not pursue any other purpose on the occasion of the operation;

4. The scale and effects of the military force used are adequately measured to the purpose and conditions of the operation. Thus, the impact on the other state’s territory is kept to the absolutely necessary minimum.

Fact-finding mission

The two disputants over Sabah both base their claim on the 1878 Deed signed by the Sulu sultan in favor of two representatives of a British company. Therefore, the end game should be to promulgate a treaty-based regime in Sabah. That is the long-term goal; but the short-term goal should be to extend immediate diplomatic protection to Filipinos in Sabah by means of a fact-finding mission.

Under the United Nations Charter, international law requires the pacific settlement of disputes by negotiation, enquiry, mediation, conciliation, arbitration, judicial settlement, use of regional agencies or arrangements, or other peaceful means of the parties’ own choice.

Third party inquiry

Under the 1907 Hague Convention for the Pacific Settlement of Disputes, the method of inquiry and fact finding can be used “to facilitate a solution of… disputes by elucidating the facts by means of an impartial and conscientious investigation.” This means that the Philippines and Malaysia should agree on a third party to carry out an inquiry, which should precede any pacific dispute settlement, specifically negotiation, mediation, good offices and conciliation.

Fact-finding commissions have been used by the United Nations and other international organizations to investigate, for example, the involvement of mercenaries in an invasion of the Seychelles in 1981 and the use of chemical weapons in the Gulf War between Iran and Iraq in 1987.

Self-defense

My humble recommendation is that the disputants settle the dispute in the first instance by the method of inquiry and fact finding. What actually happened during the recent Sabah event? Does resorting to armed force confer state responsibility on Malaysia for internationally wrongful acts?

Under modern international law, the forceful actions of states are limited by the principle of necessity and the principle of proportionality. Necessity is a component of legitimate self-defense and requires that any forceful action must be by way of last resort. Proportionality is the principle that the use of force should be in proportion to the threat or grievance provoking the use of force. These are the human rights issues that need to be immediately and equitably addressed.

To avoid developing food borne infections, avoid eating raw fish and shellfish, especially oysters and clams. Consuming refrigerated smoked seafood is also not very safe. So, it is advisable to avoid them during pregnancy.

Say No To Sugary Food
Sugary food items like cakes, ice creams, and chocolates are loaded with empty calories with no nutritional value. If you crave sugary food, eat fruits that are loaded with vital nutrients and vitamins, antioxidants, dietary fibers, etc. Consuming food with no nutritional value has no purpose at all and should be shunned during pregnancy.

Deep Fried Foods
Deep fried foods like chips, fried chicken, fries, etc are packed with trans fats that increase bad cholesterol levels and decrease good cholesterol levels. In addition, these foods are also loaded with additives that are not good for the would-be-mom and her baby. Moreover, deep fried foods have excess salt content that may increase the blood pressure in pregnant women. It is therefore always good to stay away from deep fried foods during pregnancy.

Raw and Undercooked Eggs
Raw eggs are sources of salmonella which is a harmful motile enterobacteria that causes typhoid and food poisoning. So avoid eating raw or undercooked eggs like half boiled eggs. Raw eggs can be present in Caesar salad dressings, mayonnaise etc. All these food items should be therefore avoided as well.

How to Change the MAC Address of Huawei Echolife BM622i 2011 Version WiMAX Modem?

The following step by step guide is the proper method in changing the MAC address of BM622i 2011 version.
  1. If you are using Windows Vista 7 or 8, you should turn on or enable first the Telnet Client in the Control Panel/Program and Features/Turn Windows Features on or Off.
  2. Then, download one of the following terminal upgrader (such software will be used to trigger the modem to open its telnet port).
  3. BM622i_V100R001PHLC08B029PST03 - BM622i WiMAX Firmware Terminal Upgrader Version 29

  6. In this instance, the telnet port of the BM622i modem is now open. Open Run dialog window. Type telnet 192.168.254.1 just like below then click OK button or press Enter.


  7. In the telnet command line interface, type or paste Firefly in the Login line and press Enter.
  8. In the password line, type or paste $P4mb1h1r4N4m4nT0!! . The password characters will not display in the line. Just continue typing or pasting it right. Then press Enter.
  9. In the ATP> line, type xiugai macdizhi and the new MAC address just like the image below, and press Enter. (note: the MAC Address Generators of this site had already added the prefix command on its options. You can easily copy the command plus the selected MAC address from the generators.)
  10. Then, type diag restore default to take effect the changes and press Enter. After of that, the modem will reboot. You should wait for 3 to 4 minutes until the telnet prompt displays "the connection to the host is lost". Then, you can now close the telnet prompt and the terminal upgrader window.


  11. Now go to the WebUI of the modem to view if the changes had take effect. Open a browser, type 192.168.254.1 in the address bar, then press Enter. In the WebUI type user in the Username and 0SlO051O in the Password boxes.

Click on the link above to browse to the USB jtag drivers folder. Drag the files onto your desktop and
run the setup file. If this fails to install the drivers, simply right click the 'ezusbw2k' file and click install.

If this still doesn't work, then you should browse to your control panel. Inside your control panel you will see a systems icon, click on it. From there, you will click on the Hardware tab as illustrated below.

Once you're in device manager, browse to Universal Serial Bus controller. Connect your USB JTAG and you should see an item appear from the tree within the Universal Serial Bus Controller drop down. Once you see the item added, simply highlight it by clicking once and right clicking it and going to properties. If you have successfully installed the device you should see something similar to the illustration below.

If the device is coming up with a yellow circle, windows is indicating it could not be recognized, right click it, go to properties, then click on the driver tab. Once inside the driver tab click on update driver. Now choose to manually search for your driver, click next, then click "install from a list or specified location". Now browse to either your installation cd to the "USB JTAG Drivers" Folder, or wherever you have copied the folder over to. Install the driver and unplug and replug the USB JTAG device. If it still doesn't recognize, simply remove it from the device manager list and start over.

To set the proper device on the USB JTAG software is easy. Simply browse to Tools and then Config
and set the interface to the target of choice and hit OK.

IMPORTANT:

It's always important to connect your USB JTAG properly to the target device of your choice. But when we do this, We don't always understand how crucial it is to follow a set of steps when connecting the device.

When connecting the device, you must always have the USB jtag itself powered off, which means you must have the USB jtag cable running from your computer DISCONNECTED while connecting it to your header interface. After its connected, then and only then you may pluggin the power USB cord to the USB jtag device. Once the JTAG device is powered on and fully plugged in, then you may proceed to power on the main target device, whether it be a modified modem or a DCT receiver.

When Disconnecting the USB JTAG, you do the same as the above, except in reverse order. First you will disconnect the power from the target device whether it be a DCT receiver or router or a modem. Once powered down, then you may proceed to disconnect the USB cord from the USB jtag itself, then and only then you may remove the JTAG interface from the socket/header connector.

Following the steps above will result in a long and healthy life for not only your USB JTAG, but any hardware you may choose to flash with it.

My UniFi Nightmare!!

On Friday, a group of UniFi people came to my house to install the WIRED high speed broadband (HSBB) service, an upgrade from my Streamyx. I wasn't around as I had to work but Mom was in. What I thought would be a joy turned out to be a nightmare. First of all, they come in a group of 6-8 people. And I thought it's very unprofessional not to tell the user that they will send so many people as I know it's dangerous to be home alone especially a lady with so many strangers in the house. They could have told us that there will be so many people coming and at least we can arrange to have 2 people at home.


Then, they wanted to drill a hole from the kitchen wall to the computer room. Mom had earlier discuss with them on the place to drill. To her horror, when she came into the room, the hole was drilled at another location! Imagine this senario at your house. What would you do? I think I would scream at them!


After they have completed their job, Mom gave them some Mandarin oranges and also my bowl of chocolates full of Snickers, Dove, Galaxy and M&M's! Not only they are not grateful, they even make me lose my Smartag. My Smartag was left on the chair at the living hall because my car was at the workshop and Mom noticed my Smartag was gone after the installation. She tried to call me immediately and asked if I took it but unfortunately I was at a meeting and didn't answer the call. When I called back after 20 mins, they have gone and so is my Smartag with RM43 pre loaded in the Touch N Go card!!!

Mom called Unifi and lodged a complaint. A lady calls back after 3 hours and told her that she will investigate. After another hour, she called back and passed the call to the Installation Supervisor and he said that he asked his staff and none of them took it. Duh!! If I steal something, do you think I should admit it? What kind of answer is that? Is this answer acceptable to anyone who lose something after buying a service from your company? Then Mom even asked them if they will take any action if I were to make it known to the public through social media and also to the press. The lady said, "it's your choice." And so my choice is to share my experience with all of you.


After this incident, not only Mom has to waste money and energy making the calls, I had to buy a new Smartag and Touch N Go. I spent RM120 buying a new Smartag, RM10 on Tounch N Go new card and also another RM30 for credit on top of the hundreds which I need to pay for the Unifi service. Where is the justice?

I felt so angry and disappointed with the company. Not only they have a incompetent customer service department, they may have also hired dishonest staff which users like us may fall prey to. It's just a Smartag for my case but who knows other people might have similar stories. I have written to The Star about this and hopefully they can share it at the Letters column. This serves as a warning to others to keep a watchful eye should they want to install anything at their homes. Trust no stranger. Now, should a police report be made on cases like this?

A police report has been made finally!

The reason is not for me to take action against TM but to serve as a warning to others. Yes, these people might be contractors hired by the company but it's unfair for them to send irresponsible and dishonest people to carry out the job.

Need for two or multiple connections:

Unhindered connectivity and fast access to Internet is the need of the hour for any organization that runs its business using Internet. Single ISP connection is quite risky as it leads to unbearable losses in case the network fails due to sudden disasters.

Here comes a new technology ‘Dual WAN’ that serves the purpose of maintaining network status always ‘up’ with two ISP connections (one as a backup), to function singular or together based on the mode of operation of the wan router and requirement of the organization.
Modes of Operation:

The dual modes of operation exist in dual wan routers serving dual purpose are:

1. Load Balancing: As per (below figure), we can make out the WAN setup with the dual wan router functioning as a load balancer.


In this mode, both the wan connections stay ‘active’ and load sharing between them based on the bandwidth. The dual wan load balancing avails two broadband connections aggregating the bandwidth overall. We can observe wan load balancing by the dual wan connections with one modem possessing high speed (cable modem) and other can be Digital Subscriber Line (DSL).

2. Automatic Failover or backup: In this mode only one wan link stays ‘active’ and is considered ‘primary’. When the primary wan connection fails, the alternate connection automatically takes over the control of the network and proceeds with the operations.


Hence, the name ‘automatic failover’ that avoids network disruption and collapse and maintain redundancy even at sudden disasters. So when one of the links fail, the status of the respective interface is ‘down’ and immediately alternate link becomes ‘active’ and traffic is passed through it.

CD-R King CW-5356U Tomato Firmware

I cobbled together a network-attached storage (NAS) at home to enable everyone in our house to have a shared directory for school, work and personal files. This shared directory is also accessible from outside the house – like a rudimentary personal “cloud” for our family.


It wasn’t complicated — you can go to my blog for the article on the process — because the setup was a matter of connecting an old portable USB drive to a cheap CD-R King wireless router and setting things up using a visual interface.

The magic sauce in the setup is the Tomato firmware that runs on the router. Tomato is a Linux-based router firmware that allows you to manage your device on such things as filtering and setting quality of service rules for certain types of connections so that people browsing websites don’t experience crawling connection when someone downloads using a torrent.

The Tomato firmware that comes with the CD-R King router that I use, a CW-5356U model, simplifies the setting up of a NAS by allowing you to plug a portable drive into the router’s USB port. You can set the system to auto-mount any drive that you plug into it and make it shareable in your network. You can also designate a password for your shared drive so that not everyone who connects to your Wi-Fi can access it.

The system also assists you in setting up an FTP (file transfer protocol) server that will allow you to access that drive outside of your network. You can, with the setup, access your home files from the office or even on the go.

Promise of open source

What’s even more fun is that you can view movies stored on your portable drive over your iPhone or iPad.

The router also has a facility that will allow you to connect a printer to its USB port to turn it into a network printer. It also allows you to set up complex rules that can, for example, bar your children from accessing Facebook during class days but allow you to continue using the social network.

For just P1,280, the wireless router trumps the features of branded and more expensive models.

I think the CD-R King router illustrates the promise of open source software.

Tomato firmware is open source, meaning it is released under a license that encourages sharing the software and collaborating to make it better. Any wireless router manufacturer can use the Tomato firmware for its product. By using Tomato, the manufacturer no longer has to spend to develop and maintain its own firmware. Instead, it can just concentrate on the manufacturing side of the business.

By using Tomato, CD-R King is able to manufacture a router that’s really top-class for such a low price.

But if there’s an open source project that’s really making such a huge impact, it’s Android. There are phones in the market today that are powerful and advanced and yet cost less than P10,000.
